By engaging Graeme Jack Creative for branding, design, or creative services, you agree to the following simple terms.
1. Integrity of the Work
Clients agree not to materially alter, distort, remix, or modify the creative in a way that misrepresents the original work or reflects poorly on its quality without prior discussion or approval.
2. No AI Usage or Derivative Training
Clients agree not to upload, feed, or use any delivered creative work (including logos, brand assets, layouts, or concepts) in AI tools, generators, or training systems for the purpose of generating derivative works or variations without explicit written permission.
3. No Misattribution or Piggybacking
Clients agree not to present, publish, or represent the work — in whole or in part — as having been created by another designer, agency, in-house team, AI system, or third party, or allow others to imply authorship.
4. Credit & Attribution
Where appropriate, clients agree to credit Graeme Jack Creative for branding, design, or creative work in:
• Public launches and announcements
• Press releases or media coverage
• Online project credits
• Social posts (tagging @gjackcreative when relevant)
For websites or digital products designed by Graeme Jack Creative, a small footer credit is requested in the format:
Brand and site design by Graeme Jack Creative with a link to https://www.gjack.ca
(Placement and size can be tasteful and unobtrusive.)
5. Portfolio & Self-Promotion Rights
Unless otherwise agreed in writing (for example, under NDA), Graeme Jack Creative retains the right to display and reference the work for portfolio, awards, talks, social, and self-promotion.
6. Final Approval & Responsibility
Once creative is approved or delivered, responsibility for implementation, usage, and outcomes transfers to the client. Graeme Jack Creative is not responsible for issues arising from third-party development, production, printing, coding, or deployment.
7. Limitation of Liability
Graeme Jack Creative is not responsible for business, financial, or legal outcomes resulting from the use of the creative work, including but not limited to revenue, performance, legal compliance, or market response.
8. Good Faith
These terms exist to support creative integrity, transparency, and respectful collaboration.

Payment
Payment is due within 15–30 days of the invoice date. A late fee of 2% per month (0.0667% per day) may be applied to overdue balances after 30 days. If you’re experiencing any delays, or require digital payment details please reach out.

Cancellation
In the event of project cancellation, ownership of all copyrights and the original artwork relating to the project will be returned and retained by Graeme Jack. A fee for the work completed, based on the contract price and expenses already incurred, shall be paid by the client.

Confidentiality
All correspondence and documents provided will be treated as confidential unless consent has been granted by both parties or the information is already public.

Out-of-Scope Requests
You will be notified if any requests or revisions are out of scope and if there are costs that differ from the project estimate. Out-of-scope hours will be charged at $125/hr.
